TERMS AND CONDITIONS

By checking the box below, you agree to these terms. Real Estate Media Growth, LLC, doing business as Luxury Listing Media ("we," "us"), will provide the media services you've ordered for the property in your order ("you," "your").

WHAT WE OWN

We keep ownership and copyright of everything we produce for you. That includes, but isn't limited to, photos, video, drone footage, 3D tours, and floor plans, along with the written and verbal work that goes with it: marketing plans and strategy, shot lists, creative direction, captions and copy, and consulting or recommendations we provide, whether in a document, an email, or a conversation.

If you buy from us, all of it is yours to use. If you decide to go another direction, that's completely fine, but the work and ideas we provided stay ours and shouldn't be handed to another vendor to execute.

WHAT YOU CAN DO WITH IT

Use the media to market the property, your own business, and your brand. Use it on the MLS, social media, your website, print, and paid ads. The license is perpetual and doesn't expire when the property sells, so sold posts, portfolio pieces, and year in review content are all fine.

Crop it, resize it, add your text or branding, and build it into your own marketing materials. That's all fine.

WHAT YOU CAN'T DO

Don't sell, rent, sublicense, or transfer the media to anyone else. Don't hand our files to another media or production company to make new work from them. If the property is relisted by a different agent, this license doesn't carry over to them. Your license is non-exclusive and non-transferable.

RAW FILES

We deliver finished, edited work. We don't deliver raw or unedited files, and they aren't included in the license.

SHORT-TERM RENTAL USE

If you want to use the media to market the property as a short-term rental, reach out. That's a different use and we'll sort out pricing.

IF SOMEONE ELSE WANTS TO USE IT

If a publication, builder, or anyone else asks to use the media, send them our way and we'll handle it directly.

CREDIT AND COLLABORATION

No obligation either direction. If we'd like to feature your listing we may send you a collaboration request, and you're free to accept or pass with no hard feelings. Same for us. Tag us or send us a collab any time and we'll take it if it fits. If either of us is unsure whether something works for the other's brand, a quick text or email sorts it out.

OUR OWN USE

We may use the media we create in our portfolio, on our website, and in our own marketing.

MUSIC LICENSING

Videos may include licensed music. Our license covers the music we use, but platforms match audio against the account that posts it, not against us. That means a video can occasionally get flagged or pulled on Instagram, TikTok, YouTube, or elsewhere even though it is properly licensed.

If that happens, we'll dispute it on your behalf using our license. That process is handled by the platform, not by us, and it typically takes several business days with no guaranteed timeline.

If you'd rather not risk the delay, we can add your accounts to our music license so your posts are covered directly. That's an annual add-on. Ask us and we'll get you set up. We can also deliver your video without music on request.

MEASUREMENTS AND PROPERTY INFORMATION

Floor plans, scans, square footage, and room dimensions are provided for demonstrative purposes only. They're generated from scanning technology, not from a professional survey or appraisal, and they carry variance in both accuracy and which spaces are included. Closets, mechanical areas, and irregular spaces may be measured differently or not at all, and results can differ meaningfully from an appraiser's or surveyor's figures.

Do not use our measurements as the source for any legal, contractual, or disclosure purpose, including listing square footage. If accurate figures are required, obtain a professional measurement. We aren't liable for discrepancies between our estimates and any professional measurement, or for any claim arising from their use.

We photograph and film what's there. We aren't responsible for verifying property details, conditions, ownership, or anything else represented in your listing.

EDITED AND AI-ASSISTED MEDIA

Some media may be edited or AI-assisted, including virtual twilight, virtual staging, and sky or object edits. You're responsible for disclosing edited media where your MLS, brokerage, or state regulations require it, and for confirming that what you publish meets those rules. Tell us if something needs to be changed or labeled and we'll take care of it.

PROPERTY ACCESS

You may give us lockbox codes, gate codes, alarm codes, or other access information. We share it with the people who need it to do the work: our team and the contractors assigned to your shoot. Access information you provide is stored in our booking system as part of your order record, which our team and contractors can access.

Homes for sale are accessed by a lot of people, including agents, buyers, inspectors, appraisers, stagers, landscapers, cleaners, and other contractors. We aren't liable for damage to or loss of property, or for anything that happens at the property, unless it's demonstrably caused by us. Holding access information doesn't make us responsible for anything that occurs there.

If something does happen and you believe we were involved, tell us right away and we'll look into it honestly.

HOW WE STAFF YOUR SHOOT

We perform work ourselves and through independent contractors, including photographers, videographers, and editors. Contractors may access our booking system in order to complete assigned work.

THIRD-PARTY SOFTWARE AND DATA SECURITY

We use third-party software to run our business, including our booking and delivery platform and our CRM. We don't own or control those systems and we can't guarantee their security. We aren't liable for any data breach, security incident, outage, or loss of data occurring on a third-party platform, or for anything resulting from one.

YOUR REQUIREMENTS

If you, your brokerage, or your organization have specific standards or requirements of any kind, including insurance coverage, certifications, vendor policies, or compliance rules, tell us in writing before we begin work. Absent that notice, we'll perform the work under our standard practices and coverage.

CANCELLATION, RESCHEDULING, AND ACCESS

Real estate moves fast and plans change. We're flexible, and we'd rather reschedule than charge you.

Reschedule or cancel with at least 24 hours notice and there's no charge.

If a shoot is cancelled the day of, or if our photographer arrives and can't complete the work because the property isn't accessible, isn't ready, or required parties aren't available, we may charge 50 percent of the order plus 100 percent of the travel fee if applicable. Our photographer has already committed the day and driven to the property, and we pay them for that time either way.

We waive this often, especially for weather, staging delays, and seller issues outside your control. Ask us. The policy exists for the cases where a day is lost with no notice, not for the ordinary friction of a transaction.

PAYMENT

Payment is due upon delivery and no later than three business days after delivery. We complete the work and incur our costs before you pay, so if payment isn't received in that window we may charge the card on file or pursue collection by any lawful means, including reasonable collection costs. Unpaid work means the license isn't active.

RIGHT TO REFUSE

We reserve the right to decline or discontinue service to anyone for any lawful reason.

LIABILITY

We aren't liable for delays, technical issues, weather, equipment failure, or media being temporarily unavailable. Our total liability for any claim is limited to the amount you paid for the affected order. We are not liable for indirect, incidental, or consequential damages, including lost sales or lost commissions. You agree to hold us harmless from claims arising out of how the media is used, published, or represented on your end.

OUR ROLE

We're a media company. We aren't licensed real estate agents, appraisers, surveyors, inspectors, or attorneys, and nothing we provide is professional advice in those areas. You're responsible for how you use what we deliver and for compliance with the rules that govern your business.

CHANGES TO THESE TERMS

We may update these terms. The version in effect when you place your order governs that order.
